Race in Admission: Examining the Supreme Court's Decision

College Board Forum Colloquia Session: For more than 40 years, federal law has permitted higher education institutions to consider race in a limited capacity in their admission processes. In summer 2023, the U.S. Supreme Court rendered a decision in the Students for Fair Admissions v. Harvard and Students for Fair Admissions v. UNC cases addressing the topic. This document provides institutions of higher education with information about the Court’s decision. The DOJ and DOE will continue to address all complaints of race discrimination by applying the relevant legal standards under civil rights statutes and will vigorously enforce civil rights protections, including prohibitions against racial discrimination.
